There are two categories of individuals who are entitled to apply for Form 4868. This category consists of all unmarried children, whether born in the United States or elsewhere, who have been living in the United States continuously as of the date of their birth. The age of the child at the time of his or her birth can be taken into consideration when determining whether the child meets the current age requirements. In addition, there is another category of individuals who are automatically covered under the age requirements of Form 4868. This category consists of the following individuals (although it has been observed that some Form 4868 applicants were not eligible for this category): Persons 18 and older of national origin and United States citizens who have resided in the United States continuously for at least three years and have demonstrated, to the satisfaction of the consular officer, good moral character for a period of at least six months; Persons 18 and older of nationality without citizenship who have resided in the United States continuously for at least three years and who demonstrate, to the satisfaction of the consular officer, good moral character for a period of at least six months; or Persons 18 or older of any nationality without nationality who have resided in the United States continuously for at least three years and who demonstrate, to the satisfaction of the consular officer, good moral character for a period of at least six months. To apply for Form 4868, you must complete Form 4868, Application for a Nonimmigrant Worker in an Occupational Zone, and submit it with a copy of your passport or other Form I-94, which shows residence in the United States for at least three years.
